The small print.... Pricing: Unless otherwise specified by GreenMan Boutique Services in the relevant estimate, an estimate is not a firm or fixed price quotation.  It is an estimate of the likely minimum cost of the Works, based on the information made available to GreenMan Boutique Services. Unless otherwise specified by GreenMan Boutique Services where the Customer is provided with a fixed price Quotation by GreenMan Boutique Services that fixed price shall be valid and open for acceptance within fourteen (14) days unless a longer time is specified on the face of the Quotation and, if not so accepted within the designated period shall be deemed withdrawn. GreenMan Boutique Services reserves the right to increase the price of work if; the costs to GreenMan Boutique Services of supplying the goods and services increase due to any factor beyond the control of GreenMan Boutique Services, the Client changes the specification, the Client consents to any change in specification proposed by GreenMan Boutique Services, goods or services are required by the Client with exceptional urgency, the Client causes a delay or the Client fails to provide GreenMan Boutique Services with adequate accurate information or facilities. Timing: GreenMan Boutique Services will use all reasonable endeavours to carry out the Works on the agreed dates but shall not be under any liability to the Customer if it should be either impossible or impracticable to carry out the Works on the agreed dates or at all, by reason of strike, lock out, industrial dispute, act of god or any other event or occurrence beyond GreenMan Boutique Services control. Dates specified for the commencement and completion of the Works are estimates only. GreenMan Boutique Services shall use all reasonable endeavours to ensure that it will attend on the date and time agreed.  However, it accepts no liability in respect of non-attendance or late attendance on site or for the late delivery of materials. Clear Access: The Customer shall provide clear and safe access to enable GreenMan Boutique Services to undertake the works as contracted. Work: GreenMan Boutique Services may only carry out work defined by QBCC as construction work to a maximum value of $3300. GreenMan Boutique Services may employ subcontractors to carry out any part of their obligations under this agreement at their sole discretion and may assign its rights and obligations under this agreement to any other party. GreenMan Boutique Services reserves the right to charge labour for time taken to collect parts, travel to worksite or for the transport of general or green/waste. Payment: Before the commencement of work GreenMan Boutique Services reserves the right to require  the Customer to pay an initial payment of 20% (or such greater sum if  so required) against the full Quotation Value on all quoted Works. Non-Account Customers: Payment by the Customer is due on completion of the Works. Payment must be made on such completion. Payment can be made by cash, cheque or EFT. Account Customers: GreenMan Boutique Services will seek to submit invoices to Customers within 5 days of completion of the Works, payment must be made by the Customer within 30 days after the date of issue of the invoice. Where the Customer is represented by a third party (such as a managing agent, contractor or other representative), in the event of non-payment by the Customer, the third party will be responsible for payment unless  GreenMan Boutique Services has agreed otherwise in writing. If a Customer fails to make any payment when it falls due, GreenMan Boutique Services  reserves the right to; – Charge the Customer statutory interest rates on the amount unpaid. – Charge the Customer for all reasonable costs and expenses (including legal costs and costs of any third party debt recovery service) incurred by GreenMan Boutique Services  in the collection of any overdue amounts. – There is a minimum standard administration charge of $150 whenever a Customer fails to pay all monies due immediately upon completion of a visit. – Refuse to deliver or install any balance of goods or services, or guarantee any hitherto provided goods or services until payment is made in full. – Recover materials purchased for, or on behalf of the Customer. The Customer accepts these materials remain the property of GreenMan Boutique Services  until payment of any outstanding amounts have been received. In the event of dispute, the Customer consents to allow access to the property to a company representative to retrieve all materials that remain the property of GreenMan Boutique Services Cancellation: If the Customer wishes to cancel an appointment or GreenMan Boutique Services is unable to gain access to the Customers premises to carry out the Works the Customer will be liable to pay a minimum amount equivalent to the call-out charge and the charge due for the initial period of work time. If materials for the works have been purchased or placed on order by GreenMan Boutique Services the Customer will be liable to pay  an amount equivalent to the cost of the materials ordered plus and administration fee. This shall apply irrespective of the Works having been booked by the Customer or by someone acting on the Customers behalf e.g. tenant. Risk: The Customer shall indemnify GreenMan Boutique Services against all actions, suits, claims, demands, losses, charges, costs and expenses which GreenMan Boutique Services may suffer or incur in connection with a claim by any third party resulting from a breach of the Customers obligations, undertakings, representations and warranties in connection with this Contract.
